1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of DoesNotExist, including the website, applications, software features, AI-generated character functionality, subscriptions, and related services (collectively, the "Service"). By creating an account, uploading content, purchasing a subscription, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of Service

DoesNotExist is a software platform that allows users to upload chat histories from supported messengers, select a person or persona appearing in those chats, and create a synthetic AI character that generates responses inspired by patterns in the uploaded messages. Users may also create fully synthetic fictional AI characters from user-provided profile details without uploading chat history. All characters are synthetic AI simulations. They are not real people and do not represent, replace, or impersonate any real person. Synthetic characters must be SFW and must not be used to impersonate real people, create non-consensual simulations, or bypass these Terms. The Service is a user-directed personalization tool. It does not provide therapy, emergency support, dating services, adult services, resurrection services, impersonation services, deepfake services, or human communication.

3. Operator and Legal Entity

DoesNotExist is operated by the legal entity that owns and manages the DoesNotExist service. Company details, registration number, and registered address will be added to this page once company registration is completed. In the meantime, you may contact us at doesnotexist.support@gmail.com for any legal or service-related inquiries.

4. Eligibility

You must be at least 18 years old and legally able to enter into these Terms to use the Service. By using the Service, you represent and warrant that you meet these requirements and that your use of the Service is lawful in your jurisdiction.

5. User Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate account information, keep it updated, and promptly notify DoesNotExist of any unauthorized access or suspected security issue. We may refuse registration, suspend access, or terminate accounts where necessary to protect users, third parties, the Service, payment providers, legal compliance, or platform integrity.

6. User Content

"User Content" means all chat histories, files, messages, names, profile details, images, metadata, prompts, instructions, character settings, generated conversations, and other materials you upload, submit, create, or transmit through the Service. You retain ownership of your User Content, subject to the rights granted in these Terms.

You grant DoesNotExist a limited, worldwide, non-exclusive, royalty-free license to host, store, parse, process, analyze, transform, transmit, display, and otherwise use User Content solely as needed to provide, secure, maintain, improve, enforce, and support the Service, including AI character creation, chat functionality, abuse prevention, moderation, legal compliance, and user support.

You are solely responsible for all User Content and for the consequences of uploading, processing, generating, sharing, or relying on it. DoesNotExist does not claim ownership of your uploaded chat histories and does not independently verify the legality, accuracy, consent status, or ownership of User Content.

7. Consent, Rights, and Third-Party Conversations

If User Content includes messages, personal data, likeness, name, voice, writing style, private information, or other material relating to another person, you are responsible for ensuring that you have all necessary rights, permissions, consents, and lawful bases to upload and process that content through the Service.

Where required by law, contract, platform terms, confidentiality obligations, or privacy rights, you must obtain valid consent from all relevant participants before uploading a conversation or creating an AI character based on that conversation. You must not create an AI character based on a real person or real private conversation unless you have the required consent or legal authority.

DoesNotExist does not verify that you have obtained consent. By uploading User Content, you represent and warrant that your upload and use of the Service do not violate privacy rights, publicity rights, personality rights, intellectual property rights, confidentiality duties, platform terms, laws, or third-party rights.

You agree to defend, indemnify, and hold harmless DoesNotExist from claims, losses, liabilities, damages, expenses, and fees arising from or related to lack of consent, unlawful uploads, privacy violations, personality rights violations, defamation, emotional distress, misuse of personal data, or other third-party claims involving your User Content or use of the Service.

8. Prohibited Uses

You must not use the Service to:

• Upload hacked, leaked, stolen, scraped, unlawfully obtained, or unauthorized conversations or data.
• Create non-consensual simulations of real people, private conversations, romantic interactions, sexual interactions, or intimate scenarios.
• Impersonate any person or entity, deceive others, or present AI outputs as real messages, consent, opinions, statements, intentions, or actions of the original person.
• Harass, stalk, threaten, abuse, defame, exploit, humiliate, blackmail, extort, manipulate, or emotionally abuse anyone.
• Generate or request non-consensual intimate content, adult content involving real people without explicit consent, paid sexual interactions, or content involving minors in sexual, exploitative, abusive, or manipulative contexts.
• Commit fraud, scams, phishing, social engineering, identity misuse, or reputational harm.
• Use the Service for illegal content, unlawful discrimination, or decisions about employment, credit, housing, law enforcement, healthcare, education, immigration, insurance, or other high-impact areas.
• Bypass or attempt to bypass safety systems, filters, access controls, rate limits, subscription limits, security measures, or technical restrictions.
• Reverse engineer, scrape, overload, disrupt, or interfere with the Service or its infrastructure.
• Use the Service in a manner that could harm users, third parties, DoesNotExist, payment providers, service providers, or platform integrity.

9. AI-Generated Content Disclaimer

AI characters are synthetic simulations only. They are not real people and do not represent the views, consent, feelings, memories, intentions, legal statements, medical statements, financial statements, or communications of any real person. The Service does not recreate any person. It creates a synthetic AI character inspired by patterns in uploaded data.

AI outputs may be inaccurate, fictional, incomplete, emotionally misleading, inappropriate, offensive, or inconsistent. You must not rely on AI outputs as factual, emotional, legal, medical, financial, professional, or personal advice. You must not tell others that generated messages came from the real person or use generated messages to replace real-world consent, communication, or decision-making.

10. Reporting and Takedown

Users can report unwanted, harmful, inaccurate, abusive, or policy-violating AI messages through the reporting functionality where available. If you dislike or object to an AI response, you should use the report function or contact us.

A real person who believes an AI character was created based on them without permission may contact DoesNotExist and request review or removal. We may require verification of identity, relationship to the content, and other information before acting on third-party requests. We do not guarantee that every report will result in removal, but we may take action at our discretion.

11. Moderation and Enforcement

DoesNotExist may review reports, investigate suspected misuse, restrict features, remove content, delete characters, suspend accounts, terminate accounts, preserve information, or report activity to authorities where appropriate. We may act without prior notice when necessary to protect users, third parties, the Service, payment providers, legal compliance, or platform integrity.

12. Subscriptions, Payments, Refunds, and Cancellations

Paid subscriptions provide access to software features and usage limits. Subscriptions are not payments for relationships, dating, therapy, adult interactions, human communication, or communications from any real person. Subscription fees are non-refundable except where required by law or as described in our Refund Policy. Cancellation stops future renewals but does not automatically refund past charges.

Token packs and other add-ons are digital consumable features. Once a token pack or add-on has started being used, it is non-refundable except where required by applicable law. Tokens have no cash value, are not transferable, and may only be used within the Service for eligible features such as extra photo generations and additional messages. Subscription cancellation does not automatically refund used tokens or consumed add-ons.

No refunds are provided for accounts suspended or terminated for policy violations, misuse, prohibited content, invalid uploads, inability to process uploaded files, user failure to obtain consent, or user failure to comply with these Terms. Free tier and paid tier features, quotas, prices, and limits may change. We may change pricing with prior notice where required by law or applicable payment rules.

13. No Therapy, Emergency Use, or Professional Advice

The Service is not therapy, counseling, medical care, crisis support, legal advice, financial advice, or professional advice. The Service is not designed for emergencies. If you may harm yourself or others, or if you need urgent help, contact local emergency services or an appropriate crisis resource immediately.

14. Intellectual Property

DoesNotExist and its licensors own the Service, including software, design, interfaces, workflows, trademarks, branding, and related intellectual property. You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or create derivative works from the Service except as expressly permitted by law or written permission from DoesNotExist.

15. Third-Party Services

The Service may rely on third-party providers for hosting, storage, authentication, payments, AI infrastructure, analytics, security, and support. These providers may process data as needed to provide their services. DoesNotExist is not responsible for third-party services, websites, or platforms that it does not control.

16. Privacy

Our Privacy Policy explains how we collect, use, disclose, retain, and delete information. By using the Service, you acknowledge the Privacy Policy and understand that uploaded content may require automated processing, parsing, AI model calls, storage, and security review to provide the Service.

17. Termination

You may stop using the Service at any time and may delete your account where account deletion is available. We may suspend or terminate your account or access to the Service at any time if we reasonably believe you violated these Terms, created legal or platform risk, caused harm, attempted abuse, failed payment, or used the Service in a prohibited manner.

18. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, DoesNotExist disclaims all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and that AI outputs will be safe, accurate, appropriate, or suitable for your needs.

19. Limitation of Liability

To the maximum extent permitted by law, DoesNotExist will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, data, goodwill, or business; emotional distress; third-party claims; payment disputes; or damages arising from User Content, AI outputs, lack of consent, privacy complaints, or misuse of the Service. To the maximum extent permitted by law, our aggregate liability for all claims relating to the Service will not exceed the amount you paid to DoesNotExist in the three months before the event giving rise to the claim, or USD $100 if you paid nothing.

20. Indemnification

You agree to defend, indemnify, and hold harmless DoesNotExist, its affiliates, officers, directors, employees, contractors, service providers, and agents from and against claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees, including reasonable attorneys' fees, arising from or related to your User Content, your use of the Service, your violation of these Terms, your violation of law, your lack of consent or authority, or your violation of any third-party rights.

21. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Where required, we may provide additional notice. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

22. Governing Law

Unless otherwise required by applicable consumer protection law, these Terms are intended to be governed by the laws of the Republic of Serbia. Company and jurisdiction details will be finalized and published on this page after company registration is completed. Nothing in this section prevents the application of mandatory consumer protection rules of your country of residence where required by law.

23. Dispute Resolution

Before filing a formal claim, you agree to contact us and attempt to resolve the dispute informally. If a dispute cannot be resolved informally within 30 days, it may be submitted to binding arbitration or another dispute forum as permitted by applicable law and the rules of the applicable jurisdiction. Nothing in this section prevents either party from seeking urgent injunctive relief where legally available.

24. Force Majeure

DoesNotExist will not be liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, acts of government, war, civil unrest, labor disputes, internet outages, cloud provider failures, AI provider failures, payment processor issues, cyberattacks, or other third-party service failures.

25. Severability

If any provision of these Terms is found unenforceable, that provision will be limited or modified to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
